01 · About these Terms

These Terms of Service govern your use of the KUTR platform at kutr.gg and any related applications, websites, and services (collectively, the “Platform”) operated by KUTR Pro League Pty Ltd (ABN 24 327 316 672). When we say “KUTR,” “we,” “us,” or “our,” we mean KUTR Pro League Pty Ltd. When we say “you” or “your,” we mean the person accessing or using the Platform.

You accept these Terms by submitting the waitlist form, creating an account when accounts become available, or otherwise using any feature of the Platform. If you do not accept these Terms, do not use the Platform. The governing language of this document is English.

During Phase 01, these Terms govern Founder Waitlist sign-ups only. No paid features, no Stake Battles, no subscriptions are enabled at this stage. Updated Terms will be issued with reasonable notice before any paid feature is enabled, with an opportunity to review. Questions: hello@kutr.gg.

02 · About KUTR

KUTR is a competitive ranked league for barbers and a booking, CRM, and shop-management platform built for the same barbers. The two halves run on one account and one screen: a professional cuts hair for paying clients, and the same professional competes in skill-based contests against other professionals on the league side.

The league assigns each competing barber a KBR (KUTR Battle Rating), a skill-based rating in the Elo family that updates after each contested cut. Every barber starts at 1000. Match outcomes are determined entirely by blind community voting on the submitted work; no random elements determine outcomes. Each barber also carries a REP score (0 to 100) tracking on-time rate, completion, client reviews, and other reliability signals. REP gates eligibility for higher-stakes contests and crew invitations.

KBR and REP together produce the rankings. Because every Platform contest is decided by skill exhibited in the cut and judged on the merits by voters, nothing on the Platform constitutes a wager on a chance event. The Platform is a contest of skill and a service marketplace, not a gambling product.

03 · Eligibility

You must be at least 16 years old to use any non-paid feature of the Platform: KBR, REP, bookings, free battles, daily missions, and prediction markets where they are permitted by local law. Stake Battles require you to be at least 18 years old and a resident of an approved jurisdiction (currently Australia only, in Phase 01).

The Platform launches city-by-city. Phase 01 covers Australia (Melbourne first, then national rollout). Phase 02 covers the United Kingdom, Canada, and New Zealand pending each region's gaming-counsel review. Phase 03 covers Germany, the United States on a state-by-state basis, and Ireland pending per-region clearance. Some jurisdictions are permanently excluded from Cash Battles per regulatory advice; those are listed on the Platform when account creation opens.

You are responsible for ensuring your use of the Platform is lawful in the place you access it from. We may restrict access to features, or to the entire Platform, in any jurisdiction where doing so is required for compliance.

04 · The Waitlist (Phase 01)

During Phase 01, the only feature available to the public is the founder waitlist. When you submit the waitlist form you provide your email address, the role you intend to use the Platform under (Member, Barber, or Shop Owner), your country, and (optionally) your city. We collect this information so we can notify you when the Platform opens in your region and so we can assign founder slots in the order they were claimed.

The first 500 waitlist sign-ups are designated Founders. Founder benefits, recorded against your waitlist row at the time you signed up, are honored when you create an account at Platform launch using the same email address. Founder benefits include a permanent founder badge displayed on your profile and on every battle you compete in or vote on, priority access when your region goes live, a Season 01 Battle Pass discount where applicable, and the lowest pricing the league will ever offer for your originally selected subscription tier.

Founder benefits are tied to the email address used for the waitlist sign-up. They cannot be transferred to a different email and they cannot be sold or assigned to another person. If the waitlist row is not claimed by an account creation within 12 months of your region going live, the founder slot may be released.

05 · Accounts (when launched)

Account creation is not available during Phase 01. When account creation opens for your region, you will create an account by verifying ownership of an email address and selecting a role (Member, Barber, or Shop Owner). One account per natural person. Profiles for businesses (shops) are linked to a verified individual account, not standalone identities.

You are responsible for the security of your credentials and for everything done under your account. Notify us at hello@kutr.gg immediately if you suspect unauthorized access. We may suspend or terminate accounts at our reasonable discretion for fraud, harassment, vote manipulation, fake reviews, off-platform payment circumvention, or other breaches of these Terms.

06 · Subscriptions and Pricing

The Platform offers tiered subscriptions on each role: Member tiers (Rookie, Contender, Veteran, KUTR OG); Barber tiers (Unsigned, Sharp Shooter, Head Liner, GOAT); Shop Owner tiers (Start Crew, OG Crew, Elite Crew, Dynasty, Undefeated). Pricing for each tier is published on the Platform when that tier becomes available in your region. Pricing may differ by region.

Paid subscriptions auto-renew at the end of each paid period unless you cancel. Cancellation takes effect at the end of the current paid period: your access continues until the period ends, then your account reverts to the free tier of the same role. We do not pro-rata refund completed periods.

A 14-day refund window applies to your first subscription on the Platform, on the condition that no paid features (Stake Battle entries, paid battle-pass content, consumed credits) have been used during that window. Refund requests go to hello@kutr.gg and are reviewed against the conditions above.

07 · Stake Battles (Australia, Phase 01)

A Stake Battle is a head-to-head skill contest between two barbers at a fixed stake of $5, $10, $25, $50, $100, or $250 AUD. Each barber pays their stake and a separate $2 AUD service fee at entry, processed as separate Stripe line items. KUTR retains the $2 service fee for processing and infrastructure. KUTR retains 0% of the prize pool. The winner receives the full combined stakes ($10, $20, $50, $100, $200, or $500 AUD respectively), paid out via Stripe.

Outcome is determined entirely by blind community voting on the submitted cuts during a 48-hour voting window. Submissions are stripped of names before voting opens. There is no element of chance in the outcome: the contest is decided on the work voters see, by people choosing which cut they think is better. Stake Battles are a contest of skill, not a game of chance.

Stake Battles are available in Phase 01 to Australian residents only. The structure has been designed in consultation with Australian gaming counsel and pre-cleared with the Queensland Office of Liquor and Gaming Regulation (OLGR). The structure may change subject to ongoing regulator guidance. If a regulator requires a structural change in any region, we will give reasonable notice and update these Terms accordingly.

08 · Credits and Battle Pass

Credits are virtual items used inside the Platform, to unlock cosmetic items, purchase store offerings, and access promotional content. Credits have no cash value, are not transferable between accounts, are not redeemable for currency, and are not refundable. Credits may expire on a schedule published on the Platform.

The Battle Pass is a seasonal subscription unlock that grants access to a tiered progression track during a single 90-day season. Battle Pass content does not carry over between seasons. The Battle Pass cannot be extended, refunded, or partially refunded after the season has started.

09 · Tips

When a client tips a barber on the Platform, 100% of the tip goes to the barber. KUTR retains 0% of tips, ever. Stripe processing fees on tips are absorbed by the Platform, not deducted from the barber's tip.

10 · Bookings, Cancellations, No-Shows

Clients book barber services through the Platform. Cancellation policies, deposits, and no-show fees are set by each barber or shop within boundaries the Platform defines (for example, a maximum cancellation window or a maximum no-show fee). Those policies are shown to the client at the time of booking.

KUTR processes the booking payment and any associated deposits or fees, but is not a party to the underlying service contract between the client and the barber. The barber provides the service; the barber is responsible for the work performed. If a service complaint cannot be resolved between client and barber, KUTR will assist in good faith but does not guarantee an outcome.

11 · Content and Conduct

You retain ownership of the content you upload: your portfolio photos, submitted cuts, profile copy, reviews, and messages. By uploading content to the Platform, you grant KUTR a non-exclusive, worldwide, royalty-free license to host, display, distribute, and (for submitted cuts) anonymize that content within the Platform for the purposes of running contests, displaying profiles, and operating the service.

You agree not to: harass, threaten, or impersonate other users; post hate speech or unlawful content; circumvent on-platform payment by directing clients off-platform for the same booking; submit fake reviews or attempt to manipulate votes; submit work that is not your own; scrape the Platform with automated tools; or attempt to bypass rate limits or security controls. Violations result in content removal, account suspension, or termination, depending on severity and history.

12 · Intellectual Property

KUTR Pro League Pty Ltd owns the Platform: the source code, visual identity, design system, databases, the KBR rating system, the REP scoring system, and all other proprietary components, except for content uploaded by users (which remains owned by those users subject to the license in section 11).

The marks “KUTR” and “Global Barber League” are trade marks of KUTR Pro League Pty Ltd. “KUTR” is a registered trade mark: IP Australia Trade Mark 2646208 (filed 21 April 2026). You may not reproduce the Platform, resell access to it, build a derivative platform that copies the KBR or REP rating systems, or use the KUTR name or visual identity in commerce without our written permission. Unauthorized commercial use of the registered mark may be enforced under Australian trade mark law.

13 · Disclaimers

The Platform is provided “as is”. We do not guarantee that the Platform will be uninterrupted, error-free, or free from defects. We do not guarantee ranking accuracy under contested edge cases (vote-tied outcomes, disputed submissions, and similar). Those are resolved on the published rules in force at the time. We do not guarantee the conduct of other users, the suitability of any individual barber for your specific needs, or the outcomes of bookings.

Barbers and shop owners on the Platform are independent operators, not employees, agents, or partners of KUTR. The work they perform is theirs.

14 · Limitation of Liability

To the maximum extent permitted by Australian Consumer Law, KUTR's total liability to you for any claim arising out of or in connection with the Platform is limited to the amount you have paid to KUTR in the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you have under the Australian Consumer Law and that cannot lawfully be excluded, restricted, or modified.

15 · Indemnity

You indemnify KUTR and its directors, employees, and contractors against any third-party claim, loss, or expense (including reasonable legal fees) arising out of: content you uploaded to the Platform; your conduct on the Platform; or your breach of these Terms or applicable law.

16 · Termination

You may terminate your account at any time by following the deletion flow in account settings (when accounts are available) or by emailing hello@kutr.gg. We may terminate or suspend your account on reasonable grounds, including the conduct described in section 11, with notice where practicable.

On termination, your access to the Platform ends. Data retention follows the Privacy Policy. Some clauses survive termination by their nature, including sections 11 (Content and Conduct license to existing posted content), 12 (Intellectual Property), 14 (Limitation of Liability), 15 (Indemnity), and 18 (Dispute Resolution).

17 · Changes

We may modify these Terms with reasonable notice. Material changes, anything that meaningfully affects your rights or obligations, will be notified by email to the address on file and by an on-Platform notice with at least 30 days' advance notice where practicable. Non-material changes (typos, clarifications, formatting) take effect on publication. Your continued use of the Platform after a change takes effect constitutes acceptance.

18 · Dispute Resolution and Governing Law

These Terms are governed by the laws of Victoria, Australia. The parties submit to the exclusive jurisdiction of the courts of Victoria.

Before either party commences a court proceeding, the parties will first attempt in good faith to resolve the dispute by email correspondence between you and hello@kutr.gg. If that fails after 30 days, the parties will refer the dispute to mediation under the Resolution Institute Mediation Rules in Melbourne, with the costs of the mediator shared equally.

Class actions are waived to the extent permitted by law. This clause may be unenforceable under the Australian Consumer Law and is included subject to that: nothing in this section restricts a right that cannot lawfully be restricted.
